Patch testing is required, and it is your responsibility
Instant Dye Shampoo is an oxidative color formula that contains p-Phenylenediamine (PPD) and hydrogen peroxide. These are well-documented, effective color-developing ingredients used across the hair-color industry — and, like in any hair dye that contains them, a small percentage of people can develop an allergic or irritant reaction to them, ranging from mild redness to a more serious reaction in rare cases.
How to patch test correctly
At least 24 hours before your first full application, apply a small amount of the mixed product to a small area of skin (such as behind the ear or on the inner elbow), leave it undisturbed, and check the area at intervals during that time.
Do not proceed to a full application if you notice itching, redness, swelling, blistering, or any other unusual reaction on the test area — instead, rinse thoroughly and do not use the product.
What we don’t assume liability for
Polar Hair Co Inc does not assume liability for an allergic reaction, skin irritation, or other adverse reaction that occurs when a customer applies the product without first performing the patch test described on the carton, in the instructions pamphlet, and on this page.
This does not affect your right to a refund under our 30-day guarantee, or any right that cannot be limited under applicable law — see “Rights This Policy Does Not Limit” below.
Patch test, every time. Perform a new patch test before each application, even if you have used Instant Dye Shampoo, or any other hair dye, without a reaction in the past. Sensitivity to PPD and similar ingredients can develop over time or with repeated exposure.
Individual results vary — we don’t promise an identical outcome
Why your results may differ
Starting hair color, gray percentage, hair porosity, thickness, prior chemical treatments, and how closely the application instructions are followed all affect the final shade and how long it lasts. Photos, videos, and testimonials on our site show real, individual outcomes from real customers — they illustrate what’s possible, not a guaranteed result for every hair type.
Product claims we stand behind
What we do commit to is that the product performs consistently with its label: an ammonia-free, oxidative dye you apply to dry hair for about 10 minutes, in the seven shades listed on the product page. Typical wear time is up to roughly six weeks depending on hair type and wash frequency, which is a general expectation, not a fixed guarantee for every customer.
Use as directed — the label is there for a reason
Instant Dye Shampoo is designed to be applied to dry scalp hair only, for the time stated on the carton, and rinsed thoroughly afterward. Polar Hair Co Inc does not assume liability for injury, discoloration, or damage that results from using the product outside of these instructions, including the situations below.
Leaving it on too long
Applying for longer than the instructed time does not improve results and increases the risk of scalp irritation.
Use near eyes, lashes, or brows
Instant Dye Shampoo is formulated for scalp hair only. Do not use it to color eyelashes or eyebrows, and avoid contact with the eyes.
Combining with other treatments
Using the product on already damaged, chemically relaxed, or recently bleached hair — or combining it with other chemical services — carries added risk. Consult a professional stylist first if you’re unsure.
What you’re confirming when you buy and use our product
By purchasing and applying Instant Dye Shampoo, you confirm each of the following. This isn’t legal fine print meant to trip you up — it’s the same short list printed on the instructions pamphlet inside your box.
You will perform a patch test

You understand the active ingredients
You’ve reviewed the full ingredient list on the product page, including PPD and hydrogen peroxide, and you accept the general risks associated with oxidative hair dyes.
You will follow the application instructions
Dry hair, roughly 10 minutes of contact time, thorough rinsing — exactly as printed on the carton and instructions pamphlet.
You will seek medical advice if it applies to you
If you are pregnant, nursing, have a scalp condition, sensitive or broken skin, or a known dye allergy, you’ll consult a physician or dermatologist before use.
You understand results vary
Final color and how long it lasts depend on your individual hair, and are not guaranteed to match marketing photos or other customers’ results.
You’re purchasing as an adult, for personal use
You are at least 18 years old, or purchasing with the involvement of a parent or guardian, and buying for personal or household use rather than resale.
Where our responsibility begins, and where it ends
What we are responsible for
We are responsible for shipping you the product described on our site, matching the label and ingredient list exactly, and honoring our published 30-day refund policy if the product doesn’t work out for you, arrives damaged, or is not as described.
What we don’t assume liability for
To the fullest extent permitted by law, we don’t assume liability for indirect, incidental, or consequential damages, or for harm arising from a skipped patch test, misuse, or disregard of the application instructions, as described in the sections above.
Our maximum responsibility is limited to the price you paid
Where our liability for a claim related to your order is not otherwise excluded, and to the extent permitted by applicable law, our total liability to you for that claim is limited to the amount you actually paid for the product giving rise to the claim. This limitation does not apply to liability that cannot be limited under U.S. or Texas law, including liability for gross negligence, willful misconduct, or personal injury caused by a defective product as recognized under applicable product-liability law.
Shipping carriers, payment processors, and outside links
Some parts of your order pass through services we don’t own or control. We select reputable partners, but our liability is limited to what we control directly.
Shipping carriers
Orders are handed to independent U.S. carriers once dispatched. We are not liable for delays, loss, or damage that occurs while a package is in a carrier’s possession, though we’ll always work with you and the carrier toward a resolution under our Shipping Policy.
Payment processors
Checkout is handled by PCI-compliant, third-party payment providers. We never see or store your full card number, and any dispute about how a payment provider processed a transaction is subject to that provider’s own terms.

How this product is regulated in the United States
A regulated cosmetic, not a drug
Instant Dye Shampoo is a cosmetic hair-coloring product regulated under the Federal Food, Drug, and Cosmetic Act (FD&C Act), the Fair Packaging and Labeling Act, and the Modernization of Cosmetics Regulation Act (MoCRA). Coloring agents like PPD are permitted cosmetic ingredients when labeled correctly — they are not evaluated or approved by the FDA the way a prescription drug is, because a cosmetic dye is not a drug.
The required caution statement
As required by 21 CFR 740.19 for coal-tar hair dyes, our packaging and instructions pamphlet carry the federally mandated caution statement, including the patch-test instruction and the warning against use near the eyes or on eyelashes and eyebrows. We repeat that same guidance throughout this page so it’s never something you have to search for.
Indemnification and events beyond our control
Indemnification
You agree to hold Polar Hair Co Inc harmless from claims, losses, or expenses arising from your misuse of the product, your failure to follow the instructions or this policy, or your violation of applicable law — except where the claim results from our own negligence or breach of these policies.
Events beyond our control
We are not liable for delays or failures in performance caused by events outside our reasonable control, such as severe weather, natural disaster, carrier network disruption, or labor disputes. If this happens, we’ll communicate promptly and, where a shipping commitment can’t be met, offer the option to cancel for a full refund.
Nothing here limits rights that can’t be limited by law
This policy is intended to clarify responsibilities — not to take away rights you’re entitled to. Every limitation described on this page applies only to the extent permitted by applicable law. It does not reduce or waive your rights under the FTC Act, the Texas Deceptive Trade Practices–Consumer Protection Act, the Magnuson-Moss Warranty Act, applicable state consumer-protection or product-liability laws, or your rights under our published 30-Day Money-Back Guarantee. If any part of this policy conflicts with a right you can’t legally waive, that right controls.
How this policy is governed, and how it changes
Governing law
This policy is governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law principles, consistent with Polar Hair Co Inc’s registration and operations in Houston, Texas.
Severability
